Post-Decree Matters

Circumstances may require a review of issues arising out of finalization of a dissolution of marriage action.

Courts continue to retain jurisdiction to address changing circumstances with regard to issues such as child support, custody, parenting time, and if applicable spousal maintenance.  A party who wishes the Court to modify provisions in the original Judgment and Decree does so by filing a motion with the Court with one or more affidavits setting forth that party's specific request and the basis for such request.

With regard to financial issues of child support and spousal maintenance, the burden of proof is on a party seeking modification to demonstrate a substantial change in financial circumstances justifying such modification.  Request for modification pertaining to custody and parenting time are addressed elsewhere on this site.
